《Administrative Measures for the Restriction of the Use of Hazardous Substances in Electrical and Electronic Products》

(Replaced by the original "Measures for the Control of Pollution from Electronic Information Products")

Target product: Electrical and electronic products and related accessories

Including communication equipment, broadcasting and television equipment, computers and other office equipment, household appliance electronic equipment, electronic instruments and meters, industrial appliance electronic equipment, power tools, medical electronic equipment and devices, lighting products, electronic educational and cultural products, handicrafts, sports and entertainment products, etc.

Management model: "Two-step approach"

Step 1: Identification Requirements.

For products produced since July 1, 2016, relevant environmental protection information shall be disclosed in accordance with the labeling requirements standard through self-declaration.

Step 2: Limit Usage

For the products included in the "Compliance Management Catalogue", the requirements for limiting harmful substances will be implemented in accordance with the conformity assessment system.

Identification Requirements:

Standard: "Identification Requirements for the Restriction of Use of Hazardous Substances in Electronic and Electrical Products" (SJ/T11364)

3) Environmental Protection Usage Period:

It refers to the period during which the harmful substances contained in the product will not leak or mutate, and when users use the product normally, it will not cause serious pollution to the environment or serious damage to their persons or property.

The enterprise determines the environmental protection usage period of the product by itself and marks it with the pattern of the restricted use symbol for harmful substances.

The number in the middle of the logo indicates the environmental protection usage period, measured in years.

The production date of electrical and electronic products serves as the starting date for the environmental lifespan of the product.

Regarding the production of supporting products

For electronic and electrical products purchased for production purposes, the supplier may not affix the aforementioned labels to the provided products, but should provide the procurement party with all the necessary information for labeling; correspondingly, the procurement party should affix labels to its produced electronic and electrical products, and the labeling information should cover the electronic and electrical products purchased for production purposes.

The differences between China and the EU's RoHS:

EU: Exemption clauses have been set for products that are "technically not mature and economically unfeasible". Therefore, when certain structures of the product fall under the exemption clause and the remaining parts adopt environmental protection measures, they are regarded as complying with the EU's RoHS directive.
China: There are no exemption clauses. As long as harmful substances are present in the product, environmental protection information must be disclosed and the product must be labeled.
